THIS EXPRESS LIMITED WARRANTY COVERS PERFORMANCE OF INDIVIDUAL ROOF TILES ONLY. HANSON ROOF TILE ("HANSON") DOES NOT WARRANT ACCESSORY MATERIALS OR INSTALLATION LABOR PROVIDED BY OTHERS NOR DO WE GUARANTEE YOUR ROOF WILL BE LEAK-FREE. MATERIALS PROVIDED BY OTHERS MAY HAVE SERVICE LIVES SHORTER THAN THE INDIVIDUAL TILES.

Hanson warrants that its concrete roofing tiles, when properly installed, will pass applicable moisture absorption and flexural strength tests established by the International Code Council (ICC) effective at date of manufacture. Hanson will furnish a new tile, free of charge, to replace each tile which fails the ICC tests. Hanson reserves the right to test tiles before replacement.

SPECIFIC EXCLUSIONS: THIS WARRANTY DOES NOT COVER:

1. DAMAGE TO THE TILE CAUSED DURING THE INSTALLATION
2. TILE NOT INSTALLED IN ACCORDANCE WITH APPROPRIATE BUILDING CODES AND/OR TRADE PRACTICES IN THAT SPECIFIC AREA
3. TILE COLOR SURFACE FADING, VARIATION, CRACKING, CHIPPING OR DELAMINATION OR PHYSICAL DETERIORATION OF THE COLOR COAT FOR ANY REASONS INCLUDING, BUT NOT LIMITED TO, WEATHERING, OXIDATION OR AIR POLLUTANTS
4. DEFECTS OR FAILURE OF OTHER MATERIALS USED AS COMPONENTS OF THE ROOF OR STRUCTURE
5. DAMAGE TO THE TILE CAUSED BY ROOF TRAFFIC OR FOREIGN OBJECTS FALLING ON THE ROOF
6. DAMAGE TO TILE OR STRUCTURE CAUSED BY HURRICANES, TORNADOES OR OTHER ACTS OF GOD.

HANSON'S OBLIGATION UNDER THIS WARRANTY IS LIMITED TO PROVIDING A FREE REPLACEMENT TILE FOR EACH TILE FOUND TO FAIL THE ICBO TESTS. INSTALLATION COSTS ARE NOT INCLUDED. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES WHETHER WRITTEN, ORAL, EXPRESS, IMPLIED OR STATUTORY. THIS WARRANTY EXPRESSLY EXCLUDES MERCHANTABILITY AND LIABILITY FOR COLOR CHANGE OR SHADE VARIATIONS, OR FOR ANY OTHER DAMAGES INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES, DAMAGES TO ANY STRUCTURE OR ITS CONTENTS OR OCCUPANTS AND ANY OTHER WARRANTIES EXPRESS OR IMPLIED.

Any claim arising under this Limited Warranty must be promptly submitted in writing to Hanson and must be accompanied with proof of Homeowner's purchase. If any of the tiles do not comply with this Limited Warranty, Hanson will at its own expense and within a reasonable period of time, provide individual replacement roof tiles. Hanson shall have the right, but not the obligation, to have its own representatives verify the nature, extent, and case of alleged defects. If the parties cannot resolve a claim under this Limited Warranty, any controversy will be settled by arbitration through the American Arbitration Association in accordance with its Construction Industry Arbitration Rules, and judgment on the arbitrator’s award will be entered by any court with jurisdiction. This limited transferable warranty is extended to the consumer purchaser or owner of the designated roof tile and any subsequent owner through the sale or transfer thereof.

This Transferable Warranty gives the registered owners of the structure covered by this Warranty specific legal rights and they may have other rights which may vary from state to state. Certain consumer sales may be subject to terms of specific Federal or State consumer warranty acts which may modify the warranty conditions stated above.
